Parent Sues Facebook for Using Their Child's Photo in Ad

A parent is suing Facebook for using a photo of his child -- and all minors' photos. When a user on Facebook "likes" a page it gives the permission to use the user's photo and name in advertisements to their friends about that page (through news feeds and when friend's visit the page itself).
This parent is saying that may be fine for adults, but to use a child's photo Facebook should also get permission from the parents. Facebook has stated that the lawsuit has no merit.
